13 квітня 2019 року кафедра інтелектуальної власності юридичного факультету КНУ імені Тараса Шевченка, ГО «Клуб інтелектуальної власності», Науково-освітній центр з інтелектуальної власності, Американський центр загального права (ACLC) та НДІ інтелектуальної власності НАПрН України організували довгоочікувану зустріч українських фахівців з легендою у сфері права інтелектуальної власності Елеонорою Розаті.

Елеонора Розаті є італійським кваліфікованим юристом, юрисконсультом міжнародної юридичної фірми Bird&Bird LLP, доцентом кафедри права інтелектуальної власності Саутгемптонського університету, де очолює дослідницький центр з IP/IT (iCLIC/ILAWS), редактором журналу «Journal of Intellectual Property Law&Practice», автором відомих у світі інтелектуальної власності блогів The IPKat та The 1709 Blog.

Таким чином, було здійснено активну дискусію щодо сфери авторського права, зокрема, питань гармонізації та захисту авторського права ЄС. В аспекті цього Елеонора Розаті проаналізувала центральну роль Суду справедливості ЄС у гармонізації основних аспектів законів про авторське право держав-членів і визначила ключові стандарти, що застосовуються в судовому законодавстві про авторське право, та пояснила їх значення. Її компетентна думка полягає в тому, що авторське право знаходиться в безладді через конфліктні підходи в різних європейських юрисдикціях; що на неї має бути накладена цілісна структура; і що це вже здійснюється судовою системою Суду справедливості ЄС.

Велику увагу було приділено висвітленню таких ключових сфер авторського права, як побудова економічних прав і винятки та обмеження. Також були обговорені гострі проблеми щодо інтелектуальної власності на торговельні марки та захисту прав інтелектуальної власності в мережі Інтернет.

На основі взяття участі в переговорах з міжнародними організаціями та установами ЄС (наприклад, ВОІВ, Європейський Парламент, Європейська Комісія, EUIPO), а також міжнародними професійними органами та організаціями (наприклад, ALAI, INTA, AIPPI, LIDC, ECTA) відомий професіонал у сфері права інтелектуальної власності проаналізувала переваги та недоліки у їх діяльності.

Особливо корисним з наукової та практичної точки зору став дискурс стосовно політики щодо реформи авторського права ЄС та розгляд найскладніших та найгостріших аспектів законодавства ЄС.

В свою чергу, українські фахівці розповіли про історію створення, структуру, персональний склад, успіхи в здійсненні наукової діяльності, постійні креативні заходи, які проводяться кафедрою інтелектуальної власності юридичного факультету КНУ імені Тараса Шевченка та НДІ інтелектуальної власності НАПрН України, та поділилися досвідом реформування державної системи правової охорони інтелектуальної власності в Україні.

Отже, зустріч з Елеонорою Розаті допомогла обом сторонам дискусії обмінятися корисним досвідом функціонування авторського права як в Україні, так і ЄС. Кафедра інтелектуальної власності юридичного факультету КНУ імені Тараса Шевченка, ГО «Клуб інтелектуальної власності», Науково-освітній центр з інтелектуальної власності, Американський центр загального права (ACLC) та НДІ інтелектуальної власності НАПрН України глибоко вдячні Елеонорі Розаті за цікаву дискусію та сподіваються на подальшу професійну співпрацю та партнерство.

On April 13, 2019, the Department of Intellectual Property of the Faculty of Law of Taras Shevchenko National University of Kyiv jointly with the NGO «Intellectual Property Club», the Center for Intellectual Property, the American Common Law Center (ACLC) and the Scientific Research Institute of Intellectual Property of the National Academy of Law Sciences of Ukraine organized a long-awaited meeting of Ukrainian experts with well-known on international level professional in field of intellectual property – Dr. Eleonora Rosati.

Dr. Rosati is an Italian-qualified lawyer (avvocato) with experience in the area of copyright, trademarks, fashion and internet laws; tenured Associate Professor in Intellectual Property (IP) Law at the University of Southampton, where she leads the IP/IT research centre (iCLIC/ILAWS), and also an Of Counsel at Bird&Bird LLP and the Editor of the Journal of Intellectual Property Law & Practice and a commentator on IP issues for well-known blogs IPKat blogs and The 1709 Blog.

An active discussion was held on the issues of copyright, in particular, on harmonization and protection of copyright in the EU. In this aspect Eleonora Rosati analyzed the central role of the Court of Justice of the EU in harmonizing the main aspects of the copyright laws of the Member States and defined the essential standards applicable in the copyright law and explained their significance. Her qualified opinion is that copyright law is far from harmonization in various European jurisdictions; that an integral structure should impose copyright law; and that this is already being carried out by the judicial system of the Court of Justice of the EU.

Much attention was paid to highlighting the key areas of copyright, such as the construction of economic rights, and exceptions and restrictions. Acute problems related to intellectual property rights of trademarks and protection of intellectual property rights on the Internet were also discussed.

From the scientific and practical point of view, the discourse on EU copyright policy and the most complex and acute aspects of EU legislation has become particularly useful.

Ukrainian experts spoke about the history, structure, personal composition, successes in the pursuit of scientific activity, ongoing creative activities conducted by the Department of Intellectual Property of the Faculty of Law of Taras Shevchenko National University of Kyiv and the Scientific Research Institute of Intellectual Property of the National Academy of Law Sciences of Ukraine and shared the experience of reforming the state system of legal protection of intellectual property in Ukraine.

Consequently, the meeting with Eleonora Rosati helped both parties to exchange useful experience in the functioning of copyright in Ukraine and the EU.
